Is more concerned about his rating than anything...Dr. info and ssi doc along with voc rehab.. in agreement but he is not concerned...at all more concerned about rating was contacted about filing a complaint but attorney said it would cause me problems because system is not fair and coruption is in system like all parts of goverment just keep fighting but he has not lost everything he has worked for denied because I am educated ...what goes around comes around..

Im back again on here,bc it seems like i cant get any help for anyone,still been signed up for 3yrs,already went through my back surgery ( where im messed up for life) now admitted in hospital due to me got diagnosed with copd (emphysema) couldnt breathe on my own,and still cant..im on breathing treatments everyday at home,and now they gotta give me them,and oxygen,ive got a lawyer,but he seems to be not doing much for me,this judge denied me,thats why its at the appeals council's office,he said i could work,but alot of days i cant even bend over to put my shoes on,and then this has happened.....do yaull know how hard this to loose my job in the 1st place,car,home etc from being sick like this...i dont think so,but ive seen yaull approve ppl less than 5months for bipolar or asthma attacks....i find this really crazy,but i wished i knew who to turn to get me someone else to help me,and that's not hurting me....pls someone let me know how long the appeals council's is gonna keep my case? Or are they gonna approve me,or send me back in front of another judge or what....thanks

I had my hearing yesterday and was awarded a favorable bench decision. I had sepsis in February of 2014 with multiple organ failure I stayed in a coma for two months. After I was released I had two strokes from blood clots. It left me with moderate brain damage. I can barely speak, I can't feed myself cloth or bathe by myself I can still type albeit slow. I went from being an engineer to having hard time figuring out who i was and where I was.I was still turned down initially due to insufficient paperwork. All that being said it comes down to preparation of your case. An attorney in a box is not the best solution. You should find an attorney who knows the judges in the area and knows how they want a case presented. My attorney had all my medical documentation and took time to keep it current every doctor visit. It was all presented in a very professional synopsis in chronological order with supporting evidence. So when everyone bashes the judges maybe you should be bashing your attorney. Everyone on here has merits for their case but if they are presented poorly before the hearing with little documentation would you approve it. I was very surprised how well Judge Vincent knew my file front to back She understood my inability to speak well and took the time to let me answer even if it took several minutes. My attorney never had to speak the VE said I couldn't do any work. I fully believe most judges have their mind somewhat made up before the hearing hence the importance of very good support documentation. The more questions ask of you at the hearing means they either were not answered in documentation or a weak case. Thats my two cents hope it helps.

I had my hearing, and while it seemed as if he was listening, when I got my order it became apparent he had NOT listened to anything nor considered anything. He chose to listen to a dr. who prescribes the meds my therapist recommends and sees me 15 minutes every three months rather than the therapist herself. He completely ignored not only my orthopedist, he made the assumption that I did not go to physical therapy. I did go, it was in the paperwork! I just quit because it was actually making my problem worse. Then because I am ALLERGIC to most narcotics and cannot take them, and the ones I can take are useless with my back condition it, in his words "must not be as severe as presented." So I have to be an addict to be in real pain? Because that's not bad enough he completely dismisses the doctor that the Social Security office sent me too! He completely ignored every piece of medical evidence presented to treat me like I'm faking my pain and issues. Thanks Judge Munford! Now I get to file bankruptcy since I was already three months past what I had saved. How the hell does a doctor, FOUR of them, say I'm incapable of doing significant work or any work and a judge just goes "oh well" with no accountability for it? This type of screwed system where I can have a neighbor drawing disability for her problematic foot and nothing else, and I can't get any help for multiple issues is why moving to another country is sounding better and better. Maybe if I had been a veteran he would have taken me more seriously...but no I'm just a girl who watched and worried because every male in her family serve!

Judge Owens is VERY thorough, but very fair! He is an excellent Judge in my opinion. As long as the claimant is honest and the rep is prepared, you have a good chance! He does numerous lengthy hypotheticals and asks for the rep's legal theory before testimony.

He was very kind to me, after being denied twice in the past, and he approved me with very few questions at the hearing. He is a fair judge and a good person. I do think he wants to help people and shows compassion. He had really read my records, was knowledgable about my situation and had a few questions about things. He's smarter than the other two judges I saw. Do Not Lie To Him. My lawyer advised me be as honest as I could possibly be even if it makes me look bad as being lied to or omitting things is his thing that really pisses him off. He does ask provoking questions that you may not like answering, but answer them honestly anyway. I did and I was approved, and my answers were a little embarrassing. We don't apply for disability because we're well. Good luck!

I am a citizen of these united states I feel that judge lisa Johnson went against the profesionals on my case .they said I was unable to perform any work she did not take there advise. I feel I was discrimated against .one of her questions was what type of home I lived in I answered mobile home.she just shook her head. This judge was wrong in my case and I don't know what to do to take care of my family.I worked from the time I was 14 and now I am 45 with diabetes ,depression ,degenerative disc disease in my back along with arthritis through out my body. I have tried to find work and been turned down or unable to do the work due to my condition.In my opinion this judge did not do her job .God bless her she knows she was wrong.

I just don't why I got denied from this judge..(george merchant)...I have anxiety,depression,and I have degentergive disc disease,and osterartritis. That he can tell when someone is in pain. Really? How can you physically see pain. Because of this judge i am bed bound, unemployed, no income, 35 and living with my parents. Im legally disabled, yet a man with no medical degree decides if i suffer or starve. I never got to bring in my witnesses, my lawyer was unprepared, ssi never sent me to their doctors, and I couldn't even read my statement.. seam fair?? What a joke.

I was told by my attorney's office that the Judge and the Attorney would do most of the talking, but that was not the case. I have found this judge to be extremely arrogant and dismissive of claimants. He once told a homeless client that "at least he has a tan." He also found that a schizophrenic client was able to socialize/maintain social functioning by going to church... a church he regularly attended because he thought he was Jesus. Your case could go either way- judge will often ignore numerous documents confirming disability by claiming he didn't find the claimant credible.

Although this judge runs the most informal courtroom I have ever practiced in, he quickly shows he has read the exhibits, demonstrates great respect for the claimants and their representatives, listens to what is being said with a spirit of genuine curiosity and compassion, and questions the claimants carefully when their testimony diverges from what is contained in the record. Representatives should be prepared to present their cases (judge asks them to begin the questioning, then supplements the questioning afterwards), should prepare the claimants to deal with difficult issues (illegal drug use, reported earnings after the claimed disability onset date, receipt of unemployment benefits, unfavorable treating physician opinions, etc.) and should counsel them to tell the truth. With regard to the latter point, my experience has been that this judge is far more favorably inclined to claimants who testify truthfully (even if doing so appears to weaken the case on the merits) than to claimants who paint a picture of wholly disabling functional limitations that is contradicted by evidence in the record (objective findings, activities of daily living, previous inconsistent statements, etc.).

This judge told my brother in law that he was stupid and he didn't care that my brother in law had Colon cancer and prostate cancer. My brother in law is having his colon and prostate removed tomorrow. We may not be smart enough to go to law school but we were brought up to know you don't disrespect someone by calling them stupid. I think this judge needs to take a good look in the mirror, he might just see stupid looking back at him. My Brother in Law will have to wear a colostomy bag and a ostomy bag........and he doesnt qualify for SSC/Disibility??? Yes sitting in a chair and judging people he would be able to work but he does construction so you tell me how he is not qualified? SMH! Very disappointed in the in the judicial process...isn't this why we pay into SSC?? this judge is cold hearted and mean. Good luck to anyone who goes before him!

I had my hearing last week after a little more than 2 years of waiting. Judge Lawson had reviewed my case notes thoroughly and asked questions about my doctors, their treatments, and medications. He asked what a typical day is like, what I do differently now than before I got hurt, how the medications affect my life, and what my previous job duties consisted of. He had also pulled my SS earning record and was aware of past earnings as well as the hours required to earn it. After getting a response from the VE that I am not able to return to the medium and heavy duty jobs I have done in the previous 15 years, he told me right then that he approved my disability case. Anyone going before him will find him fair, thorough, and straight to the point. Bless him for easing my burden.

Judge Brower started my hearing by asking about how I was and breaking the ice with Super Bowl small talk. He asked why I thought I was disabled and I went on to explain. He sincerely viewed all the medical evidence that my lawyers turned in prior to the hearing And asked me questions about my various Dr. visits. There was some evidence and things I said, however, that did make him have some doubts about the validity of my claim. In the end he gave Me sufficient opportunity to explain myself and he took my sincerity into serious consideration in regards to making his final decision. He apologized for upsetting me emotionally and thanked me for "fighting for myself". Things look very good. He's a good and fair judge.

I had my hearing today with Judge Lisa Johnson. She was tough and very straight to the point! Asked me about my medical conditions and what prevents me from working and then asked the VE if there were any jobs I could do and he said no! Judge Lisa Johnson ruled on the record that I was approved! My advice is to be honest and listen very carefully to her questions she speaks fast, but if you pay attention you will do fine! It's been 2 yrs fighting for this and it was a relief to get a decision the same day on the record! I was a Legal Assistant so this being a desk job already I couldn't stand up at any jobs! Prayer works!

I've had one hearing with this ALJ. He was very professional, calm, and gave claimant a very fair and complete hearing. His award rate has come down a bit over the last year. He will ask some general background questions and then will give you specific direction on how he wants the medical testimony developed. He asks a full range of hypotheticals. He ended up denying this claim for lack of supportive medical but it was still a very fair hearing and a well reasoned decision.

This judge is cold-hearted and has no empathy for mental illness claimants. He not only called three psychiatrist and a social security psychologist, two primary doctors liars but me as well. His problem is since he can't see the illness physically then you can work. I believe he wants me to go out in the workplace and have one of my mental breakdowns whereby I hurt someone or vice-versa for him to see that a person that suffers with bipolar I & II are very moody people who can't always control themselves. I also suffer with manic depression, PSTD, social anxiety, anxiety, claustophic, panic attacks, OCD, high blood pressure, asthma, bronchitis, heart disease,etc. I am a 50 year old black female who has worked 30 years of her life always giving and caring for others. I have attempted suicide twice because I am my wits end. It took almost 4 years for this unfair system to tell me no I don't qualify for sdi in which I paid into the system. I guess, I will have to prove to this ### and the rest of them that I refuse to let others come here and live off of me when they never worked a day in this country.

wow, This Judge will look for any excuse to dismiss or deny a case! Very Lame ones indeed! I know many disabled folk that are dependent on professional trained pets to assist them to function. This Judge dismissed my niece's case that suffers from M.E. because she and her husband has a Lab that is older very docile, this dog helps her severe depression! He mentioned in the Denial letter because she cares for this pet she should be able to work..HOW Insulting! praying for this Judge to have a more caring and empathetic heart while he practices in Alabama~

I agree whole heartedly with the comment that this judge is heartless and disconcerned for the well-being of the claiments. Percentages on this site do not lie. Obviously he only approves less than a quarter of all cases. So if you experience a unfavorable decision from this judge, despite being dishearten with the system, you are not alone! His statistics seem quite unbalanced coupled with a whim of something smelly~ Try to find out before hand who your judge may be before hand because your chances of winning is very slim. In addition if you appeal to council or start all over, its within your rights to request another judge~ God Bless

As a person has been in this business for years, I felt obligated to note that I disagree with the poster below who referred to Judge Merchant in such a disrespectful manner. Yes, he reads the whole record- to include the treatment notes. He does confront the claimants; however, he is very compassionate and respectful to all who come into his hearing room. For future claimants, be wary of what you read on sites like these. Listen to your representative and be truthful.

ALJ Merchant is clearly knowledgeable of the SSA statutes and assertive in his hearings. On the conservative side for dispositions, but his decisions do not tend to be unreasonable.

i have 10lb lift restriction,cant sit or stand over 15min at a time,two herniated disc L4-L5 and L5 s-1,nerve damage in right shoulder,nerve damage in back,i have to use a cain and back brace,migraines,anxiety and depression im sure i missed something but with all this he denied my disability GOD only knows why i wonder want else has to be wrong with me to get help!!!!

well i found out what the problem was with my disability my selection of ostrander as my doctor and bennett to replace her was where i went wrong. I have linear fractures and bone missing in my left shoulder and lower back but several local judges seem to be property owners at the company i worked for ostrander one of them. I simply had to leave this county and get medical treatment to come up with proof.

The experience that I had with Judge Lawrence Levey was that it was the first time I have ever dealt with a government employee who was humane and respectful. He asked tough questions, but I felt that he was fair.

although judge edison wasnt my judge I understand your frustration my hearing was june 20th and I havent recieved a decision letter in the mail yet. My conditions is left leg ampuation, psoriatic arthritis, and post tramatic stress syndrome. now if that doesnt qualify as disabled after i worked many years in the workforce then what would? I often think the same thing you guys do. what does it take to get approved roll in there on a hospital bed or a wheelchair. however my judge was extremely nice and seemed interested in my case but the low approval rates they have speak for themselves

This ALJ barely even looked at me during my hearing (June 2012) and never reviewed any medical findings after July 2011, which confirm my diagnosis. Also he basically said I was a liar and therefore denied me any disability benifits at all. I am on 19 prescribed medications, I can barely function while taken them, they have impaired my thinking skills. I also have hyper somnia, means I sleep for hours at any given time of day, but somehow that evidence was not in his report. If I was pushed in to the hearing in a wheel chair with drool hanging from my mouth, maybe he would believe me. But since I am an upbeat person ( to hide all the crap on the inside)he sees me as functional. I have good days and I have bad days , some days I have no pain and other days all I have is pain. I'm a mixed bag-who in their right mind would hire a person like myself? I can't sit or stand for too long, i can only do minimal light non-thinkinh kind of work, I will fall asleep on the job, I will forget the task I've been given and wander the office. I would get fired within a week, that or get that special baseball helmet for my head. this man infuriates me

judge martin is so nice something about him the day of my hearing he was very into everything i had to say and like my other post said it does not matter if he does not award me i will still respect him he was not mean in anyway to me his job has to be hard and i would not like to have to decide something like that daily because naturally when people do not get what they wanted or expected they then suddenly do not like you on the other hand if you were to get what you wanted you would love him but in this world things do not lways go the way that you would like sorry you had a bad day and i hope all works out for you in the end!!!

i am still waiting the results of my hearing with judge martin i think he was very nice and made me feel as if he was listening to everything i had to say and taking it into consideration he seemed interested and caring and no matter how my case turns out and what decision i get i will still have respect for him because he was listening and he has a job to do that has to be very difficult to see who is actually disabled or just trying to collect so i will had it to him they do what they think is best and if denied and you are truly disabled i encourage you to take it that extra step i do not think the judges are looking at anyone and acting as if they are lying under oath but just simply trying to find weather the conditions meet the ssa codes good luck to everyone and very much luck for those who truly need it!!!

this judge had one of the highest approval ratings a few months ago now one of the lowest. I think if you had a case denied by him lately you should file an appeal.HE IS NOT BEING FAIR.He is making a lot of errors on his cases and I PERSONALLY think he is in fear of his job .He denied cases in record time ,wrong statements ,times and dates.He is very slick and will lead you on in your hearing to hang yourself. I work hard all my life and payed into the ssa but alot of ssi people are approved by him. I think this judge is showing early signs of dementia and should not be handling any cases now.

fauded my case....didnt even do what the appeals council told her to do about my depression that it may have worsend after the evailuation of dr. kennon ,phd and dr.frankie stanley.a pychiatist has be treating me since december of 2010 and she didnt belive what he said about my diagnoses for major depression, recurrent severe...so she sent me to a consecutive examination and dr.harod savell diagnosed me with major depressive disorder with psycotic features and both doctors said that i am very disabled..what is right with this county....i have nothing and no money and no insurence i guess they just want us to die off with our sickness....... this judge showed me no justice and wrongfully denied me.

This judge is nonetheless heartless and disconcerned of the well-being of Alabama's disabled citizens.Obviously he gets his income and doesnt think of what clients he presides over need to survive on a daily basis.He did not look at the basic facts of my trial and after waiting for 18 months with no income and the inability to work my case was denied. Being someone with a life-threatening illness I could have filed for another appeal but that would have put me waiting at least another 18 months before it would proceed to the appeals court. Instead I decided to reapply hoping that the seriousness of my disablities would be re-evaluated by someone with a little more understanding of what it is to want to do better for yourself when you cant.

no stars intimidating acts like your a criminal for being disabled very unprofessionL did not even give me (CLAiment) the opportunity to express my disabilities was very ugly and mean to me and my representative. did not want to here how medications affected my work ability(s). HE said should have been included in restrictions by doctors report. medicine affects people diferent and the cautions are on the bottle. However, i wa not given the opportunity to tell how they affected me. i was never asked how my pain and other conditions affected my dAILY LIVING. ( which is tremendous) no work history or what i thought I may be able to do was discussed. (other than brief assumptions) Restrictions and limittations were asked of me,even though they should all have been shown in fCE and medical records. I do not know what the Drs. said I only know whAT I can and can't do. THIS judge has some anger issues or other problems ....... maybe he should apply for disability because he is not fairly and rightiously doing his job.....There are problems concerning this judge and his job duties and dealing with people 4/05/2012
