I found Judge Lowell Fortune to be fair, kind and pleasant. My disability hearing was presented to Judge Fortune after I had brain surgery in 2014. I had never been to a disability hearing much less my own, so I admit I was a little afraid. I was happy that it was over with quickly and Judge Fortune decided in my favor at the end of the hearing instead of making me wait for weeks as I was told could be possible. During the questioning he was very pleasant and smiled several times. I am thankful that my experience during the hearing process was simple, quick and not as stressful as I thought it would be.

I beg to differ with the comments left on the page, Judge Lawritson was very fair to me, he reviewed my case, he explained all of the legalities to me because I had no clue of what to do and what nots, he also asked if I was being represented and I said no because I didnt know of the time frame to get a lawyer and was unaware that it was too late for me to get a lawyer until the judge (Lawritson) told me, well I felt hopeless and screwed and didnt know what to do and the judge(Lawrtison) said he would personally see to it that we get all of my records because they want to charge me for my own records....judge Lawritson assured me that he would get the records and further discuss options once he had recieved the rest of my records. I at least was given the benefit of the doubt and told that he would either make the decision himself or have me back for another hearing but that ether way for me to hang in there and he would work as fast as he was able to help me get through this whole mess, so Judge Lawritson....thank you for truly showing that you care and that you are willing to help out people who arent familiar with what to do in these cases. Keep up the good work and thank you again......

Worst judge yet I've been denied 4 times twice by him and the appeals council keeps remanding it back to him........ Don't u think that means he's missing something in my opinion he's to old to be on the bench! Didn't ask me anything during heading just read what last judge before him said..... Been fighting for this for almost 6 years!!!!!!!!!! Need a new judge but no the appeals council remanded it back to him AGAIN.

Judge: Thomas S Inman

I just wanted to say Judge Inman's rule was not a just one. While he acknowledged my illnesses, he did not acknowledge all of them. In addition to SLE which has many manifestations, I have Fibromyalgia, arthritis, no cartilage in my knees, disc disease in my back and cervical dystonia (this being the one he ignored), he actually showed great confusion I regard to his understanding of my headaches. I did not claim they were from migraines, they were due to the dystonia, yet he mentioned several times how my migraines were much better in response to treatment. Migraines were not a major issue on my end and my lawyer never used them as part of our argument, they were simply listed as one of my ailments that I live with. It appears the judge went through my records for the sole purpose of evidence of hypochondria. One if his examples was a doctor visit I had in November of 2013, I thought I was having a Lupus flare, he notes that my doctor didn't think so and if it was then it was a mild one.

Very unhappy this judge mixing up all the facts in the case and also not looking into the misdiagnosis on my case file. I had severe pain in my back upper and lower and possible nerve damage, I was bed ridden for months even and currently in physical therapy. The judge had the vocational counselor come out and tell me I could do work in a factory which indeed could harm my health condition, I could not believe this when I heard it. Not only did the judge make many assumptions she thought I was just perfectly fine, she took everything out of context and reversed it backwards on me. I even sent her more evidence as to her mistakes in her judgements, she never looked at my case and dismissed everything.. my new evidence and xrays , Dr's letters etc. The fact my case was from the get go misdiagnosed and my previous condition of 15 years erased and now I am classified as having some mental condition I was appalled and disgusted with this I will surely appeal with a lawyer. No wonder she has a 43% approval rating, thanks for the facts.

She misstated evidence, misrepresented testimony, ignored evidence, excluded specific conditions and made numerous factual errors. If you appear in front of this judge, your claim is going to be denied.

Denver ODAR getting a really good ALJ in Judge Day. Judge Day has been in Shreveport ODAR and was a pleasure to go before as a representative. She is fair and a great disposition for a Judge. I wished she had not left Shreveport, but I don't blame her for going to a place like Denver. Best wishes to her!!

Got denied for no good reason. The Disability system isn't nearly adequate to adress all the disabled in this country. This is why we have so many crazy people sleeping on the streets.

My wife had a hearing she denied me to be present during the hearing for absolutely no reason even my wife's attorney stated he had never seen this before. She discriminated against me from my occupation. Very sad a judge can be this petty.

Judge: Mark R Dawson

The Honorable Judge Dawson is a very fair and compassionate judge, taking time to research rare or lesser known disorders that may not be on the Social Security Administration's list of approved disabilities in order to hand down a fair and informed judgement.

I just received my denial letter, I saw Judge Patricia Henry, every paragraph was lies, she twisted and contorted my records and testimony to fit her denial. She basically committed perjury! She contradicts herself in different paragraphs in regards to my disabilities and abilities, she needs to get off the bench STAT! I will be filing all sorts of complaints and even taking this to our legislature. We presented her with evidence, she twisted factual evidence to being non-existent! If you get this judge, kiss your case good-bye!

This "man" is the worst type of person possible and should not be adjudicating disability cases. He is heartless and has zero empathy for anyone appearing before him. He has denied me twice and I demanded my case be sent before a new judge this third time. I'm hoping that Judge Hartman is more sympathetic to my situation.

Judge: NICHOLAS J LO BURGIO
8/8/2014 10:08:59 AM

Judge LoBurgio is the most thorough ALJ I have ever had, and through the years of practicing I have learned a great deal from doing hearings before him. I appreciate that he knows the case record very well, and in my opinion strives for fairness in hearing every case before him. He can be tempermental at times, however when you are prepared for your hearings this is rarely a problem and has no impact on his decision-making. Generally he is very pleasant and has a good nature. He is very knowledgeable of the all the pertinent rules and regulations and applies them fairly, and his manner of examining medical experts and vocational experts is un-matched. Having a chance to work before him has strengthened my skill-sets, and I believe he sets a great standard for ALJ's hearing claims. Overall, if you have a case before him, I am of the opinion he applies the law the way he is supposed to do.

I have been before Judge Stroup several times over the years representing claimants. She is always personable and allows the claimant's to have a fair and full hearing. In my opinion, she weighs the evidence objectively and without pre-conceived biases as some ALJ's seem to do. She knows her record well, and is thoughtful and balanced. Even in the cases that have been disapproved, my clients felt respected by her which says a lot about her nature.

I have appeared many times before ALJ Millington and she has the most pleasant personality and temperament of all the Denver ODAR judges. Of course, everyone has a bad day, I guess, but a "nasty temper" is something I have never seen. She is also one of the few judges I have appealed, obtained a remand from the US District Court back to her, and, after a rehearing, she agreed with me and reversed herself, granting benefits. I am always relieved to get her on an SSDI or SSI claim. I know she is going to treat my client like a human being and she will listen carefully. I think she reads the file well before the hearing.

Judge: Kurt D Schuman
3/20/2014 3:41:51 PM

Judge Schuman tends to stick close to a script for the beginning of his questions and then delves deeper if he sees anything that isn't in the record or that is confusing. He tends to be moderately prepared for the hearings beforehand, reviewing the evidence somewhat. However, he's cagey and tries to confuse reps with whether he'll grant or not. Hearings tend towards an hour long. Nice in person to most reps, but he'll push claimants ******* certain issues, such as lack of exercise, post-onset work activity, age, and even how they pay the bills. He is very understanding to inability to afford treatment. Apparently he was kicked out of the Denver office and does most hearings in Casper, WY. All in all, a middling type of judge.

Judge: Lowell Fortune

Judge Fortune wrote in his decision that I did not display the symptoms of PTSD in the courtroom. I thought it was the judge's job to examine the facts and put together the puzzle from what the doctors diagnosed, not to diagnose conditions themselves, after all they are not doctors so they do not have the training to diagnose medical conditions. I was discharged from the military for PTSD and am currently rated 100% disabled by the Veteran's Administration for PTSD, based on their doctors who specialize in PTSD, but I guess judge fortune (I did not capitalize intentionally) knows more about PTSD than the dozen or so doctors I have seen and am still seeing from the military and VA. Also, he was very disrespectful and utterly rude. Two things that have no place from a judge. Maybe his parents never taught him to treat people properly. I have never said someone should be fired but judge lowell fortune has no business as a judge!!!

Judge: Rebecca LaRiccia
1/28/2014 3:46:12 PM

When the court started judge Lariccia read off to me my condition. She had not read all my medical and when told this at the hearing she still could not accessit without my lawyers help. She went into the hearing with precocieved notions and never changed them. When the vocational counselor from the state went over jobs he stated i couldnot perform light duty with my conditions I stated to the Judge. In her decision Judge Lariccia said she agrees with the doctor that I have severe pain but I can still perform a light duty job. Then she spelled out what i could perform as it relates to lifting. Noware in any reports or FCE did it say I could do that. Also she said the vocational couselor said I could perform light duty with my spoken evidence. He never said that. I faxed in a release for the hearing proceedings and never recieved them. In my opinion Judge Lariccia was not prepared for the case, and looking at her basis for decision she never read all the medical.

this alj has published papers on TBI and KNOWS the disability effects differ from day to day, even hour to hour. I truthfully answered "yes" bcuz i have swept snow off my 2x2 foot front porch some days--said that qualifies me to be a maid..never mind I forget where I park my car or if I've put away the milk, turned off the stove, etc. Johns Hopkins brain surgeon report AND NIH study for effects of headaches that last for days...also said I could be pipe fitter -- omg, documented nerve damage to my dominant hand. He disregarded the fact that I get lost easily and pointed to all the jobs that are 20 miles away from where I CAN navigate.

What is Judge Fortune's allowance rate on remand?

Judge: Rebecca LaRiccia
3/27/2013 7:45:59 AM

This ALJ used to be in the NHC in Chicago. Her award rate has been fairly consistent. She is pleasant, sometimes ready to start hearings early. She asks for opening and then she questions claimant. A good, strong work history is always a plus. She will do bench decisions too. In my experience this ALJ is very fair. All judges have to formuate opinions on crediblity and severity of symptoms.

Judge fortune or mis-fortune as he is referred to by those who have the mis fortune to be in his court is the worst type of person the world has produced. I have been in front of him three times and each time he is more rude and strange the previous times. I had four experts witnesses find in my favor, two are doctors, one was fortunes own expert on my kind of heart condition and the vocation expert, he had gone out and found another doctor that said I was not disabled. To call this obscene is an understatement and to call him a professional or judge is and over statement. If you get this judge, be afraid, very afraid. He is charge of peoples lives and shouldn't be in charge of a broom.

Judge: Lowell Fortune

He is far from a fair judge and he should be brought up on charges for how he treats the people who come before him. I have never met a more unpleasant person in my life and for him to be someone in authority and sit in judgement of others lives is wrong. VERY WRONG. To call people liars and say they are fat, lazy, or any of those things is wrong. He should not be allowed to stand in judgement of people until he has walked in their shoes! He has no respect for anyone's problems in life, so why should they give him respect. FOR HEAVENS SAKE, he rolled his eyes. Teenage girls do that when they are told to do something. This man is no better than a spoiled teenager only he is given the job of calling someone a liar!! I sure would like to see if he treats his family & possible friends the same way he treats the people who come before him in his job. Being a fair judge is a good thing, being one who does not actually listen to the facts before him and makes a decision is a whole other ball game.
